Section 4 — Know Your Rights (Reference)

Your HOA can regulate placement, screening, and noise — but in most states cannot outright prohibit a properly installed standby generator. Key state protections:

  • Texas: Property Code §202.019 prohibits HOA bans on standby generators ≥7 kW
  • Florida: Courts have ruled HOAs cannot make installation "impractical" if code-compliant
  • All states: HOAs must respond within their CC&Rs-specified review period (typically 30–45 days); non-response may constitute automatic approval
